The FBI requires the VECHS Waiver Agreement and Statement Form, the Privacy Act Statement and the Noncriminal Justice Applicant’s Privacy Rights form to be provided to each applicant, prior to the time they are fingerprinted.
Your organization is responsible for securely storing these forms and for having them readily available for FBI and FDLE audits. These documents will not be stored by FDLE, the Clearinghouse, or the LiveScan Provider.
Again, to satisfy FBI requirements, you will need to continue providing each applicant a copy of the
Privacy Act Statement and
Privacy Rights document in writing prior to or at the time of fingerprinting. Each applicant must also sign
VECHS Waiver Agreement and Statement Form before submitting their fingerprints (original to be retained by the entity;
do not remit a copy to FDLE).
- FDLE recommends you make this a part of your application/hiring process.
- This must be an auditable process and incorporated into agency policy.
- The documents must be provided in writing, either physically or electronically to each applicant. The documents cannot be posted for the applicants to read.
- You may not pass this responsibility to the LiveScan provider capturing the applicant’s fingerprints.
