Third-Party Relationship Determinations
I am entering into a contractual agreement with a third-party, how do I know if it is a subrecipient or a contractor?
The first step for any OCJG recipient is to complete the Subrecipient vs. Contractor Determination Checklist. The checklist is designed to ask simple yes/no questions to determine if the activities fall under the purview of a subrecipient relationship. If you respond, "yes" to any of the questions, you are entering into a relationship with a third-party subrecipient. If all of your responses are "no", more than likely you are in a relationship with a third-party contractor.
It is important to note, not all contractual service relationships are crystal clear, black-and-white. There is occasionally some overlap and areas of concern. If you experience this during the course of your project, you are encouraged to reach out to your grant manager for discussion and guidance.
