Florida Methamphetamine Precursor Monitoring System

Request for Exemption
 
Florida Statute 893.1495 provides an exemption from the Florida Methamphetamine Precursor Electronic Monitoring System reporting requirements for retailers that sell over-the-counter cold or allergy medicines that contain ephedrine and related compounds used to manufacture methamphetamine.  To be eligible for an exemption, retailers must:
  • not have a computer with an internet connection that is available in any sales area within the retailer location and
  • sell less than 72 grams of ephedrine in a 30-day period.  
Retailers who sell ephedrine-based products and meet both requirements listed above may apply for an exemption with the Florida Department of Law Enforcement (FDLE).  FDLE will review the request for exemption, and will grant or deny the request within 14 business days.
 
Note: Retailers that do not sell ephedrine-based products or retailers that dispense these products only with a prescription, Florida Statute 893.1495 does not apply and therefore, a request for exemption is not required.

To apply for an exemption, the retailer or retail manager must:
1.
Complete a Request for Exemption form (Form: FDLE I&FS-012).
2.
Sign the form.
3.
Mail the completed form to:

Retailers denied an exemption and disagrees with FDLE's decision can:
1.
Request, in writing, reconsideration of the denial based upon mistake of fact or law.
2.
State the basis for reconsideration and provide any documentation available to support the request.

*FDLE will provide a written response to the request for reconsideration.
 
Retailers granted an exemption must:
1.
Maintain the exemption letter within the place of business, and make it available upon request by any law enforcement officer.
2.
Notify FDLE, in writing, and within 5 days of any change in its exemption status.  Exemption status may be affected by a change in the sales volume of ephedrine or related compounds and/or a change in the availability of technology to access the Florida Methamphetamine Precursor Monitoring System.
3.
When conditions nullify the basis of retailer's exemption, the retailer is responsible for complying with Florida law requiring electronic reporting of purchases of ephedrine and related compounds using the Florida Methamphetamine Precursor Monitoring System.  More details and contact information regarding this program will be available at a later date.  Check back to this website for updates.
